The Federal Trade Commission (FTC) has proposed banning non-compete agreements in the USA as soon as April 2024. Doing so is going to have a direct impact on the mobility of workers who have valuable trade secret knowledge, which they may not realize they cannot “take with them.” In order to protect themselves, companies are going to have to be much more proactive in the identification & protection of trade secrets, as well as expend more time & energy educating privileged employees exactly the secret nature of what they are handling & the restrictions they’ve personally agreed to around the information.
